Interrogation and COVID-19

The World Health Organization has declared a pandemic in the world.

Note that a pandemic is an epidemic characterized by the spread of an infectious disease throughout several countries of the world.
In turn, on March 11, 2020, the Cabinet of Ministers of Ukraine introduced quarantine in Ukraine due to the spread of coronavirus in the world. Some restrictive measures have been introduced to counter the epidemic.

However, life does not stand still, as law enforcement agencies, despite the dangerous epidemic situation in the country, continue to call for interrogations and sometimes insist on carrying them out despite the above circumstances and the arguments of the persons.

Therefore, pay attention to the fact that in accordance with the provisions of Article 138 of the Criminal Procedure Code of Ukraine, force majeure circumstances, in particular, such as epidemics and similar circumstances, can serve as a good reason for a person not to appear to call an investigator.However, it must be emphasized that it is necessary to notify the investigator of the indicated circumstances that are the reason for the non-appearance of the person on call in order to prevent the application to the called person of the consequences established by Article.139 of the Code of Criminal Procedure of Ukraine.
