Alimony is a mandatory payment that goes to the family to support a minor or a family member who needs it. In case of divorce or in case of evasion of their direct obligation to support the child, one of the parents is obliged by law to pay a certain amount every month. According to the current legislation, alimony is collected in a mandatory manner if the child has not yet reached the age of majority, that is, 18 years old, and in the case of education - 23 years old.
The amount of alimony is paid with the consent of the parents or compulsorily by a court decision, and when determining its amount, the age of the child, the living wage stipulated by the law and real earnings and the number of children in the family are taken into account. But it cannot be less than half of the subsistence minimum.
Therefore, taking into account the above criteria, the recommended alimony payments from January to December 2023 will be:
• 2272 hryvnias. - up to 6 years;
• UAH 2,833. - from 6 to 18 years;
• UAH 2,684. - from 18 to 23 years old (in the case of education).
In general, civil, administrative and criminal liability is assumed for the evasion of the payment of funds (alimony) established by the court decision for the maintenance of minors and disabled persons in Ukraine.
It should be emphasized that martial law does not exempt from the obligation to pay alimony, even if the debtors do not have an official income
