On March 30, 2021, Verkhovna Rada of Ukraine adopted the Law of Ukraine "On Amendments to the Code of Administrative Offenses of Ukraine (KUoAP) on the establishment of liability for obstruction of inspections on technogenic and fire safety" (entered into force on April 17, 21).
This Law introduces administrative responsibility of entrepreneurs for preventing state supervision bodies from conducting inspections on issues of technogenic and fire safety. An entrepreneur is obliged to allow officials of state supervision to carry out an inspection (provide an opportunity to inspect buildings and premises, territory, provide documents and explanations). Otherwise, for hindering the inspection, the Law provides for the imposition of a fine on the offender from UAH 1,700. up to UAH 3400
In addition, the norms of the law will make it possible to draw up protocols for an offender on an administrative offense for obstructing an inspection, and for obstructing the execution of a protocol, a police officer has the right to conduct an administrative detention of an offender until his identity is established.
Considering the above, in order to avoid negative consequences in the form of administrative liability and legal proceedings, entrepreneurs should conscientiously comply with all the established requirements of technogenic and fire safety at the enterprise.
