On December 2, 2020, the Verkhovna Rada of Ukraine adopted the Law “On Amendments to Certain Legislative Acts of Ukraine on Strengthening Liability for Offenses in the Sphere of Selling Electronic Cigarettes and Liquids Used in Electronic Cigarettes” (hereinafter - the Law).
The law prohibits the sale of electronic cigarettes and liquids used in electronic cigarettes to minors (under the age of 18).
Starting from January 1, 2021, the Law introduces administrative liability in the form of a fine of 400 to 800 non-taxable minimum incomes (from UAH 6,800 to UAH 13,600) for violating the rules of trade in electronic cigarettes and liquids used in electronic cigarettes.
Regarding violation of the rules of trade in electronic cigarettes and liquids used in electronic cigarettes, a person who was fined for a similar violation during the year, is subject to administrative liability in the form of a fine of 800 to 1,400 such minimums (from UAH 13,600 to UAH 23,800) with confiscation of trade items.
In addition, the Law provides for the laws “On state regulation of production and circulation of ethyl alcohol, cognac and fruit, alcoholic beverages, tobacco products and fuel” and “On measures to prevent and reduce the use of tobacco products and their harmful effects on public health” to use the terms “e-cigarette” and “liquids used in e-cigarettes” in the meanings given in the Tax Code of Ukraine and introduce restrictions, including for minors, on the circulation of e-cigarettes and liquids used in e-cigarettes.
