On October 27, 2023, the amendments to the laws of Ukraine "On the Citizenship of Ukraine" and "On Ensuring the Functioning of the Ukrainian Language as a State" in the part related to the acquisition of Ukrainian citizenship will enter into force.
The introduced changes provide for obtaining a personal commitment from a person who, in the event of acquiring Ukrainian citizenship, must pass a series of exams within two years, in particular, on the basics of the Constitution of Ukraine, the history of Ukraine and the level of proficiency in the state language, with mandatory confirmation of passing these exams, by submission of relevant documents that will confirm the passing of such exams.
The specified obligation will have a written form in the form of a statement directly from the "applicant" to acquire Ukrainian citizenship.
The procedure for taking the exams will be established by the Cabinet of Ministers of Ukraine, it should be noted that in a number of European countries the specified procedure is mandatory and does not cause any surprises or doubts in the society, because obtaining the citizenship of a particular country is first of all a "privilege".
The changes also provide that the grounds for deprivation of Ukrainian citizenship will, in particular, be non-fulfillment of obligations to pass the specified exams within the stipulated period.
It should be noted that the changes will affect applications submitted after October 27, 2023, while applications that are or will be submitted before that date will be considered in the order in effect before that.
In our opinion, it is necessary to pay attention to the absence in the changes of the mechanism of verification of the commitments made, regarding taking the exams within the specified period, which may further lead to the formality of introducing these changes. But only time can tell if this will happen.
